These Terms and Conditions govern your booking and use of Treasure Hunt Barcelona's team building activities. By making a booking, you agree to be bound by these Terms.
1. Definitions
"Treasure Hunt Barcelona" ("the Company", "We", "Us" or "Our") refers to Treasure Hunt Ltd. "The Client" means the purchasing party. "The Guests" means the service recipients. "The Services" means the offerings supplied under these terms.
2. Basis of the Contract
A binding agreement forms when both parties complete the Booking Confirmation form. Treasure Hunt Barcelona operates exclusively under these conditions, and these terms override any Client-stipulated alternatives unless confirmed in writing by the Company.
The Client warrants authorization to accept these terms on behalf of the Guests. The Company's servants, agents and independent contractors receive the benefit of every exemption and limitation of liability contained in these Conditions.
3. The Services
Descriptions in marketing materials present general ideas only and do not form part of the contract. Treasure Hunt Barcelona reserves the right to modify the equipment used in service delivery.
4. Price
Pricing follows the Booking Confirmation Form. A deposit of 0% of the price (including any applicable VAT) is due at booking.
Clients must pay the balance before the service is provided. Cancellation penalties apply as follows:
- Forfeiture of the deposit for any cancellation.
- 30% of the contracted price for cancellations made within ten days of the activity.
- 50% of the contracted price for cancellations made within three days of the activity.
Additional charges are invoiced separately with fourteen-day payment terms. Overdue payments incur statutory late payment interest, plus reasonable debt recovery costs.
5. Limitation of Liability
Clients and Guests sign liability disclaimers upon request before services commence. Treasure Hunt Barcelona accepts no liability for loss, injury or damage of any nature whatsoever, whether direct or consequential, arising from the provision of the Service or from property damage.
6. Treasure Hunt Barcelona's Authority
Clients and Guests must comply with the Company's safety directives. The Company's opinion on safety matters is final, and dangerous behavior or excessive alcohol consumption permits removal from the activity without any refund obligation.
7. Force Majeure
The Company bears no liability for losses arising from circumstances beyond its control, including adverse weather, natural disasters, strikes or supply disruptions. While refunds are not offered in these cases, the Company will attempt to arrange alternatives or a reschedule for weather-related cancellations.
8. Governing Law and Disputes
These Terms are governed by the laws of Spain. Any dispute arising from these Terms or your booking will be submitted to the courts of Barcelona, Spain, without prejudice to any mandatory consumer-protection rights you may have under the law of your country of residence.
9. Changes to These Terms
We may update these Terms from time to time, for example to reflect changes in our Services or in the law. We will post the revised Terms on this page and update the "Last updated" date above. Continuing to book or use our Services after a change takes effect means you accept the revised Terms.
10. Severability
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be considered severable and will not affect the validity and enforceability of the remaining provisions.
11. Entire Agreement
These Terms, together with your Booking Confirmation, constitute the entire agreement between you and the Company regarding your booking, and supersede any prior agreements or understandings, whether written or oral, relating to the same subject matter.
